Working with Zoowa
Terms of Service
These terms cover use of the Zoowa website and services. A separate written proposal, order or customer agreement may set additional terms for a particular service. If there is a conflict, the service-specific agreement applies to that service.
1. About these terms
Zoowa is a South African AI technology business offering AI visibility and presence management, AI and MCP integrations, agent-readiness infrastructure, automation and agentic commerce services. These terms apply when you access the Zoowa website or use a Zoowa service, unless a separate written agreement says otherwise.
By using the website or a service, you agree to these terms. If you use a service for an organisation, you confirm that you are authorised to accept these terms for it.
2. Zoowa services
Services may include analysis of how AI platforms describe or recommend a business, recommendations for improving its digital presence, and client-specific software, integrations, MCP servers, APIs, workflows or agentic commerce connections. The precise scope, features, delivery dates and responsibilities for paid work are set out in the applicable written proposal or agreement.
Zoowa may update or change a service to maintain or improve it. Reasonable steps will be taken to communicate material changes that affect an agreed service.
3. Your responsibilities
You must provide accurate information, use the services lawfully, and ensure you have the rights and permissions needed for information, systems, accounts and content you ask Zoowa to use or connect. You are responsible for the instructions and access you authorise, and for keeping your credentials secure.
Before acting on an AI-generated response, analysis or recommendation, you should review it for accuracy and suitability. You remain responsible for your business decisions, customer communications, regulatory obligations and any actions taken through systems you control.
4. AI integrations and third-party services
Some services use or connect to AI platforms, cloud infrastructure, hosting, communications, payment services or other providers. Information sent to those providers may be processed under their own terms and privacy practices. Their services and availability are outside Zoowa's control, and Zoowa does not promise that a third-party service will produce a particular result or meet a customer's requirements.
AI outputs can be incomplete, inaccurate or change over time. AI visibility analysis describes observed results and is not a guarantee that an AI platform will mention, recommend or select a business. Agentic integrations act only within the access and actions configured or authorised for them; customers should review permissions and use appropriate human approvals for consequential actions.
5. Fees and payment
Fees, billing timing and payment arrangements for paid services are set out in the relevant written proposal, order or agreement. No fee or payment schedule is created by these website terms alone. Any applicable taxes will be handled as stated in the service documents and applicable law.
6. Intellectual property
Zoowa and its licensors retain rights in Zoowa's pre-existing software, tools, methods, templates, documentation, branding and other materials. You retain rights in information and content you provide, subject to the rights needed for Zoowa and its service providers to process them to deliver the agreed service.
Any ownership or licence terms for customer-specific deliverables will be set out in the relevant written agreement. You may use Zoowa materials made available through a service only as permitted by these terms and the applicable agreement.
7. Privacy and confidentiality
The Zoowa Privacy Policy explains how personal information is handled. Where a customer agreement includes confidentiality or data-processing terms, those terms apply to the relevant service. Please do not provide personal or confidential information unless it is needed for the service and you are authorised to share it.
8. Acceptable use
You must not use Zoowa services to break the law, infringe another person's rights, interfere with the security or operation of a service, attempt unauthorised access, or send malicious code. You must not use an integration to take actions beyond the permissions granted by the relevant system owner.
9. Availability and results
Zoowa aims to provide services with reasonable care, but website and service availability may be interrupted for maintenance, security, technical issues or circumstances outside Zoowa's reasonable control. Uninterrupted access, a particular AI platform result, increased visibility, sales, or completion of a transaction by an AI agent is not guaranteed.
10. Suspension and ending a service
A service may be suspended or ended as set out in the applicable customer agreement. Zoowa may restrict access where reasonably necessary to address a security risk, suspected unlawful use, misuse of a service, or a material breach of these terms. Where reasonably practicable, notice will be given to the customer with an opportunity to address the issue.
11. Liability and legal rights
Any service-specific liability terms agreed in writing apply to that service. Otherwise, each party's rights and liabilities are determined by applicable law. Nothing in these terms excludes or limits a right or liability that cannot lawfully be excluded or limited, including any rights that apply under the Consumer Protection Act 68 of 2008.
To the extent permitted by law, Zoowa is not responsible for decisions you make based only on AI output or analysis without appropriate review, or for the operation of third-party platforms and systems outside Zoowa's control.
12. Changes to these terms
Zoowa may update these website terms from time to time. The latest version will be published here, with its last updated date at the bottom of the page. Changes to an existing customer agreement will be handled under that agreement.
13. South African law and contact
These terms are governed by the laws of South Africa, subject to any mandatory rights or jurisdiction rules that apply. For questions about these terms, contact Zoowa at [email protected].
